SD Codified Law 1-54-5. Consultation with tribal government regarding state programs.

It is the policy of the state to consult with a tribal government regarding the conduct of state government programs which have the potential of affecting tribal members on the reservation. This section may not be construed to confer any substantive rights on any party in any litigation or otherwise.

SD Department of Agriculture and Natural Resources (DANR). As of spring 2021, this is the department within the SD state government that handles all environmental and regulatory matters. This department was formerly the Department of Environment and Natural Resources (DENR).

Stay updated on air quality permits, mining exploration permits, ground water discharge, surface water discharge and quality reports, mining permits, oil and gas drilling, waste disposal permits, water permits, and more.

It’s important to stay current on DANR public notices because per SDCL 46-2A-4, all notices of applications to DANR are published “in at least one official newspaper in each county where the water will be diverted or used or where project works will be located.”

This means that if people do not read the Black Hills Pioneer, for example, they will not learn about relevant applications in the northern Black Hills.
